<p>법무법인강산이 발표한 표준규약과 군포시가 발표한 표준규약이 거의 대동소이하나 약간은 다른 점이 있습니다. </p>

<p>우리 아파트는 재건축 대신 리모델링한다.</p>

<p>아파트 수직증축 리모델링!</p>

<p>아파트 리모델링은 재건축과 비교하여 비용·기간 등 여러 면에서 장점이 있다.</p>

<p>먼저 비용측면에서 노후불량건축물로서 재건축대상이 될 때까지 사용하기 위하여 보수·보강하는데 드는 비용 및 철거 후 새로운 건축물을 건설하는 데 드는 비용과 비교하여 리모델링 비용이 저렴할 것으로 예상되고, 재건축을 할 때까지 주차장 부족, 노후 설비, 부대복리시설 부족, 보행 및 차량동선 혼재 등으로 인한 생활의 질을 개선할 수 있고, 재건축 기간보다는 리모델링 기간이 짧다는 장점이 있다.</p>

<p>또한 ① 재건축초과이익환수제와 무관하고, ② 조합원 지위양도 제한이 없고, ③ 준공 15년 이상이면 리모델링이 가능하고, ④ 수평·수직 증축 허용으로 일정부분 일반분양이 가능하고, ⑤ 종전 구조물을 그대로 유지하여 배치가 바뀌지 않으므로 동·호수 변경으로 인한 갈등이 없고, ⑥ 주민동의율도 75%라는 장점이 있다.</p>

<p>이 책은 「주택법」 및 「건축법」에 산재되어 있는 아파트 수직·수평 증축 리모델링에 대해서 종합적인 해설을 하고 있다. 즉, 리모델링 개념, 기본계획, 조합설립방법, 조합운영방안, 시공자등 협력업체 선정방법, 안전진단문제, 사업계획승인 및 행위허가, 이주·철거·착공·일반분양·감리·사용검사, 형사처벌 등 리모델링 전반을 다루고 있다.</p>

<p>특히 「주택법 시행규칙」 제7조제6항은 “국토교통부장관은 주택조합의 원활한 사업추진 및 조합원의 권리보호를 위하여 표준조합규약 및 표준공사계약서를 작성ㆍ보급할 수 있다.”라고 하나, 아직 아파트리모델링조합에 대해서는 표준규약이 없다.</p>

<p>그래서 각 조합별로 조합규약 내용이 다르고, 나아가 일부는 부적절한 내용들이 규약에 포함되어 있다. 이에 법무법인강산은 군포시리모델링지원센타, 강경호법무사와 함께 「아파트리모델링조합표준규약권고안」을 작성하였다.</p>

<p>이 책은 공무원이나, 조합관계자, 협력업체 등이 리모델링에 관한 실무지식을 쉽게 익히도록 2023년 5월까지 나온 관련 판례를 첨부하여 해설하고 있다.</p>

<p>한편 수직증축방법, 안전진단방법 등 건축기술지식은 저자들의 분야가 아니므로 논외로 하고 있다.</p>

<p>모쪼록 이 책이 세대수 증가형 아파트 리모델링에 대한 지침서 역할을 하기를 기대한다. </p>
